Whilst there are several professional associations for architects including the Royal Institute of British Architects (RIBA) and the Architects Registration Board (ARB), both of which deal with disciplinary matters, non of them are able to assist with compensation claims for damages as a result of an architects professional negligence which is the preserve of lawyers. In order to make a successful architects professional negligence claim, it is necessary for there to exist a duty of care and for subsequent negligent action to have occurred which has directly caused financial loss. A duty of care exists in the normal architect/client relationship and negligence is defined as a failure to take reasonable care. Losses that can be claimed must be directly associated with the negligent act and must be reasonably foreseeable. Losses that are unpredictable will be deemed to be too remote to claim.
